Regular Meeting April 9, 2014 Chair Noyes moved to approve the April 9, 2014 minutes as submitted. Seconded by Vice -Chair Robin 'Thorn and carried by a unanimous vole. PUBLIC HEARING A. SPA 02-14 - ORDINANCE NO. 14-2034 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 02-14) CHANGING THI", LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM COUNTY MIXED (MXD) TO CITY OF LONGWOOD INFILL AND MIXED USE (IMU) AND AMENDING THE LONGWOOD DESIGN GUIDEBOOK DISTRICTS MAP TO ASSIGN THE EAST END PLANNING DISTRICT FOR THE PROPERTY WITH PARCEL ID 26-20-30- 5AR-ODOO-0171; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. Anjum MUkh.erjee explained this item was generated due to a voluntary annexation request by the owner of 389 N Highway 17-92 to be connected to city water. The first reading has taken place and the City Commission and Public Hearing are set for June 16, 2014. Voluntary amtexations tend to spur a small scale amendment for a land use change. For that purpose this annexed property will become Infill & Mixed Use (IMU) as is most properties along that corridor within the East End Overlay. Presently there is a pawn shop on the property, which is a non -conforming use meaning it would not be allowed to be there according to the Longwood Development Code standards. In this case if the non -conforming use were to cease for 90 days then it would lose its non -conforming status. From that point only an allowable use designated for Infill & Mixed Use would be allowed. There are two free-standing signs on the site which the City no longer allows therefore we are negotiating with the property owner in bringing the site into compliance. Vice -Chair Robin Thorn asked what would happen if he sells the property versus the business ceasing for 90 days. Anjum Mukhei jee responded it is the use that matters over ownership. Member Greg Cetera asked what negotiations are being made because of the two free standing signs that are not in compliance. Anjum Mukherjee responded staff recommended he remove the signs and do some landscaping. The parking appears to be fine. There are other legally non- conforming signs existing within the City of Longwood that would no longer be LPA Meeting Minutes - October 9, 2013 2 allowed under the current sign ordinance. The signs at this particular site would be treated as one of those signs. Only change of copy is allowed with a non- conforming sign. Any other changes would trigger the property owner to be in compliance per the Land Development Code. Chair Bruce Noyes stated in the language it says as a condition for approval of the annexation staff will work with the applicant to ensure the following will be enforced within 90 days of the annexation. Anjum Mukherjee replied we do have a time frame of 90 days. Chair Bruce Noyes responded that the two pole sign would be removed. Anjum Mukherjee answered the way it will appear before the Commission is that, both signs will be removed. Depending on their final decision. we will officially have 90 days to work with the owner and bring the site into compliance. Vice -Chair Robin Thorn asked if the signs were necessary for the business owner to advertise his business. Anjum Mukherjee responded the signs are blank so he is not using either of them. Alesia Carrinaer asked why he does not want to take them down.. Anjum Mukherjee replied this may have to be a condition that we enforce. Chair Bruce Noyes moved that the Land Planning Agency recommendv approval for the Comprehensive Plan Amendment SPA 02-14 Future Land Use Map for the following property previously mentioned at 389 N Highway 17-92. Seconded by vice -Chair Robin Thorn and carried by a roll call vote. 6. DISCUSSION AND SCHEDULE FOR FUTURE AGENDA ITEMS Chair Bruce Noyes asked if there were upcoming items. Anjum Mukherjee replied there may be a Land Planning Agency meeting scheduled for July 9, 2014 for discussion of Longwood Development Code text amendments. We are working with Weston Park on submitting documents for the Development Agreement. They have submitted preliminary plans to the Building Department. Maronda Homes has submitted the first building permit of the 20 homes that will be built in the Longwood Station subdivision. Meadowridge Estates on Lake Emma Road is now only 2 homes away from being built -out. LPA Meeting Minutes — October 9, 2013 3 7. ADJOURNMENT Chair Bruce Noyes moved to adjourn.
