CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 7:00 p.m. 2. APPROVAL OF THE MINUTES FROM THE July 31, 2014 HEARING: Special Magistrate Goodblatt approved Minutes from the July 31, 2014 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. 4. There were no respondents present. CEO Howington stated that this is a 2" repeat violation of CC, Chap. 38, Sec. 38- 141 High Grass and Weeds. The Respondents were brought before the Special Magistrate on 9/26/13 as repeat violators at which time they were found guilty and ordered to maintain full compliance with all ordinances and regulations of the City of Longwood. CEO Howington stated that a repeat Notice of Violation was issued on 7/28/14 after finding the grass was again in excess of 10". The notice was mailed certified to the Respondents, Orange Crown Transit Partners, LLC as well as to the registered agents, Orange Crown Holdings, LLC and Ryan vonWeller. No compliance date was required due to the fact that this was a repeat violation and this was properly stated on the notice. CEO Howington stated re -inspections were done on 8/7/14 and 8/13/14 and the grass had not been mowed. Pictures were presented as evidence. The Notice of Hearing was mailed certified to the Respondents on 8/13/14. On 8/14/14 a copy of the Notice of Hearing was mailed to both respondents by first class mail, posted at city hall, and copies posted on both the house at 247 Orange Ave. as well as on the vacant lot. CEH 08-28-2014 Page 4 of 6 CODE ENFORCEMENT HEARING City Commission Chambers 175 West Warren Avenue Longwood, FL 32750 CEO Howington stated that on 8/20/14 she did an inspection and found that the grass had been mowed with the exception of the area within the enclosed chain link fenced area. Upon re -inspection on the day of the meeting the grass within the chain link fenced area still had not been mowed. CEO Howington stated that on 8/26/14 several a -mails were received from Ryan vonWeller and these a -mails were read into evidence. The Special Magistrate asked questions of CEO Howington. The Special Magistrate made her findings that service was properly made in this case. A public nuisance existed at the cited property since July 28, 2014 due to an excessive growth of grass & weeds on a lot which is located within 100' of improved property within the City of Longwood. The property is so unsightly that it negatively impacts adjacent property owners land values. The property may become infested with rodents. This is a repeat violation for the 2nd time. It is the finding of the Special Magistrate that the Respondents are to pay an administrative cost of $263.50 within 30 days of service of the order. It is further ordered that the Respondents shall pay a fine of $3,100.00 which represents 31 days @ $100.00 per day and will continue to accrue at the rate of $100.00 per day for each day the violation continues to exist beyond this date set for compliance.
