14-1368 Amend Resolution No. 13-1336, Concering Building Permit FeesRESOLUTION NO.14-1368 A RESOLUTION OF THE CITY OF LONGWOOD, FLORIDA, AMENDING RESOLUTION NO. 13-1336 CONCERNING BUILDING PERMIT FEES TO PROVIDE FOR CITY COMMISSION AUTHORITY TO MAKE PARTIAL DEFERRALS OF BUILDING PERMIT FEES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, Section 553.80, Florida Statutes authorizes the governing body of a municipality to provide a schedule of fees for the enforcement of the provisions of the Florida Building Code; and WHEREAS, Chapter 18, City of Longwood Code of Ordinances provides for the establishment of building permit fees and building permit -related fees to be adopted by Resolution; and WHEREAS, on August 19, 2013, the City Commission adopted Resolution No. 13-1336 establishing the most current building permit fees and building permit -related fees; and WHEREAS, the City Commission desires to amend Resolution No. 13-1336 to grant authority to the City Commission to partially defer building permit fees when determined tc be in the best interest of the City; and WHEREAS, the City Commission finds that adopting this Resolution, in part, is an effort to promote economic development and the City exercises its Home Rule authority and its authority under Chapter 163 and 166, Florida Statutes hereunder. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA AS FOLLOWS: Section 1. Intent. The above recitals are hereby adopted as the legislative purpose of this Resolution and as the City Commission's legislative findings. Section 2. Amendment. Section I of Resolution No. 13-1336 is hereby amended to insert the following new language at the end of the 1' page of said Resolution after the sentence reading, "Fifty percent of the permit fee will be paid in advance for plan review and shall not be eligible for refund" (underlined language is being added; provisions not included are not being amended): "The remaining fifty percent of the permit fee is to be paid prior to the issuance of the building_permit(s). However, the City Commission may, by written agreement with terms acceptable to the City, approve the deferral of the remaining ffttpercent of the building_permit(s) fee, or a portion thereof, up to a point in time that is no later than Page 1 of 2 prior to final inspection and issuance of certificate(s) of occupancy if determined by the City Commission to be in the best interest of the Cites Section 3. Conflicts. If any Resolutions or Ordinances or parts thereof are in conflict herewith, this Resolution shall control to the extent of the conflict. Section 4. Severability. If any portion of this Resolution is determined to void, unconstitutional, or invalid by a court of competent jurisdiction, the remainder of this Resolution shall remain in full force and effect. Section 5. Effective Date. This Resolution shall take effect upon adoption. ADOPTED this 17'' day of November, 2014.
