14-2048 SPA 03-14 Changing Land Use DesignationORDINANCE NO.14-2048 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 03-14) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM COUNTY LOW DENSITY RESIDENTIAL (LDR) TO CITY OF LONGWOOD LOW DENSITY RESIDENTIAL (LDR) FOR THE PROPERTY WITH PARCEL ID 33-20- 30-513-OB00-0080; FROM COUNTY MEDIUM DENSITY RESIDENTIAL (MDR) TO CITY MEDIUM DENSITY RESIDENTIAL (MDR) FOR THE PROPERTY WITH PARCEL ID 33-20-30-504-0000-0040; AND FROM CITY LOW DENSITY RESIDENTIAL (LDR) TO CITY MEDIUM DENSITY RESIDENTIAL (MDR) FOR THE PROPERTIES WITH PARCEL ID'S 33-20-30-505-000-004B, 33-20-30-505-0000-004A, 33-20-30- 505-0000-004D, 33-20-30-504-0000-0010, 33-20-30-505-0000-0040, 33-20-30- 504-0000-0030, 33-20-30-504-0000-0050, AND 33-20-30-504-0000-004A; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida Administrative Code; and WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing on October P, 2014 to consider the Small Scale Plan Amendment request; and recommended the proposed Small Scale Plan Amendment (SPA 03-14) be approved by the City Commission; and WHEREAS, the City Commission held an initial reading on November 3r, 2014 and a public hearing on November 17`h, 2014 pursuant to the requirements of Chapter 163.3187, FS. Ordinance 14-2048 - Page 1 of 6 WHEREAS, the Small Scale Plan Amendment adopted by this Ordinance is internally consistent with the City of Longwood Comprehensive Plan and its goals, policies and objectives. LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the property described as: 1065 Ridge Street Property ID#: 33-20-30-513-OB00-0080 as depicted in EXHIBIT A, from County LOW DENSITY RESIDENTIAL (LDR) TO City LOW DENSITY RESIDENTIAL (LDR), attached hereto as though fully contained herein. SECTION 2: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the property described as: 750 Florida Avenue Property ID#: 33-20-30-504-0000-0040 as depicted in EXHIBIT B, from County MEDIUM DENSITY RESIDENTIAL (MDR) TO City MEDIUM RESIDENTIAL (MDR), attached hereto as though fully contained herein. SECTION 3: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the property described as: 605, 651, 675, 711, 789 Highland Street and 112, 114 Clifford Avenue Property ID#: 33-20-30-505-0000-004B, 33-20-30-505-0000-004A, 33-20-30-505-0000- 004D, 33-20-30-504-0000-0010, 33-20-30-505-0000-0040, 33-20-30-504-0000-0030, 33-20-30-504-0000-0050, 33-20-30-504-0000-004A Ordinance 14-2048 - Page 2 of 6 as depicted in EXHIBIT C, from City LOW DENSITY RESIDENTIAL (LDR) TO City MEDIUM DENSITY RESIDENTIAL (MDR) attached hereto as though fully contained herein. SECTION 4: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this Ordinance. SECTION 5: If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. FIRST READING this 3rd day of NOVEMBER, 2014.
