A RESOLUTION OF CITY OF LONGWOOD, FLORIDA,
CREATING AN INCENTIVE AND SUBSIDY PROGRAM FOR
THE ABANDONMENT OF SEPTIC TANKS AND
CONNECTION OF BUILDINGS PLUMBING TO THE CITY'S
WASTEWATER SYSTEM FOR PROPERTIES WITHIN
CERTAIN DESIGNATED PROJECT AREAS; PROVIDING
FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE
DATE.
WHEREAS, the City of Longwood has been awarded funding provided through the St.
Johns Water Management District to pay, in part, for the extension of City wastewater lines
through the City and the connection of wastewater lines to properties currently served by septic
tanks along with the abandonment of said septic tanks on properties to be connected to the City's
wastewater system;
WHEREAS, the City of Longwood using its own funds in conjunction with the funding
to be received from the St. Johns Water Management District desires to strongly encourage the
cooperation of property owners within the designated project areas to allow the City and its
employees and contractors to access private property to cause the cleaning and abandonment of
septic tanks and the connection of building plumbing to the City's wastewater system; and
WHEREAS, Ordinance No. 16-2090 adopted on July 18, 2016 gives the authority for the
City Commission via resolution to create incentive or subsidy programs to encourage or facilitate
the abandonment of previously approved and properly functioning septic tanks and the
connection of such properties served by septic tanks to the city's wastewater system; and
WHEREAS, such incentive and subsidy programs may include, without limitation,
wastewater capacity fee, development assistance fee and connection fee waivers and financial or
manpower assistance in the abandoning of septic tanks and making the building's plumbing
connection to the city's wastewater system; and
WHEREAS, the City Commission desires to create an incentive and subsidy program for
the aforesaid purposes as set forth in this Resolution covering those properties located within the
Lake Ruth Area Project, N.•C.R. 427 Project, S. Longwood Phase 2 Project, Island Lake Project
and Lake Wildmere area Project generally identified on the maps attached hereto as Exhibit "A"
(`Benefitted Properties"), and more specifically identified within the files of the City's Public
Works Department; and
WHEREAS, the property owners of the Benefitted Properties shall be required to
execute a sewer utility license and right -of -entry in a form acceptable to the City ("Sewer Utility
License") in order to receive the benefits of the incentive and subsidy program created by this
Resolution; and
WHEREAS, failure of a property owner to execute the Sewer Utility License and
cooperate and allow the timely abandonment of the septic tank and connection of their buildings'
plumbing to the City's wastewater system pursuant to this Resolution shall cause the property

owner to forfeit their opportunity to receive the wastewater capacity fee, development assistance
fee and connection fee waivers set forth in this Resolution and free services of abandonment of
septic tank and connection to the City's wastewater system, and requires them to be responsible
for abandoning their septic tanks and connecting their properties to the City's wastewater system
at their expense pursuant to Ordinance No. 16-2090 and Section 381.00655, Florida Statutes; and
WHEREAS, pursuant to Ordinance No. 16-2090 and Section 381.00655, Florida
Statutes, when the City's wastewater system becomes available for connection to a property,
such property is required to connect to the City's wastewater system within a certain time after
notification, and be required to pay a monthly base rate for wastewater service as a readiness to
service charge; and
WHEREAS, the City Commission finds this Resolution is in the best interest of and for
the health, safety and welfare of the citizens of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF LONGWOOD, FLORIDA, AS FOLLOWS:
SECTION I. Recitals. The foregoing findings are incorporated herein by reference and made a
part hereof as substantive provisions.
SECTION H. Sewer Connection Incentive and Subsidy Program. The City Commission hereby
establishes a Sewer Connection Incentive and Subsidy Program for the Benefited Properties
generally identified on Exhibit "A" attached hereto. The owners of the Benefited Properties
shall be required to timely execute a Sewer Utility License within the time period requested by
the City in order to participate in the Sewer Connection Incentive and Subsidy Program. As part
of the Sewer Connection Incentive and Subsidy Program, the City will cause at its expense: (i)
the extension of wastewater mains within the rights -of -way adjacent to the Benefited Properties;
(ii) installation of distribution lines connecting the wastewater mains to the Benefited Properties'
building's plumbing; (iii) disconnection, cleaning and abandonment of septic tanks on Benefited
Properties; and (iv) waiver or self -payment of the wastewater capacity fee, development
assistance fee and connection fee typically charged for the connection to the City's wastewater
system. The City Public Works Department will notify property owners of the Benefitted
Properties of this Sewer Connection Incentive and Subsidy Program and request their timely
execution of the Sewer Utility License in order to accomplish the purposes of the Program.
SECTION III. Budgetary. The City reserves the right at any time to terminate, in whole or part,
the Sewer Connection Incentive and Subsidy Program or to remove any of the designated
properties from the list of Benefitted Properties set forth in this Resolution due to budgetary
concerns or other matters for the benefit of the health, safety and welfare of the citizens of
Longwood. The City is not representing and warranting the timing of commencement or
completion of any of the services and wastewater improvements provided for herein, and the
City shall not be held liable for any delays in completing the services or improvements or for any
service interruptions.
SECTION IV. Conflicts. All resolutions or part of resolutions in conflict with any of the
provisions of this Resolution are hereby repealed.

SECTION V. Severability. If any section or portion of a section of this Resolution proves to be
invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity,
force, or effect of any other section or part of this Resolution.
SECTION VI. Effective Date. This Resolution shall become effective immediately upon its
passage and adoption.
