16-2109 Amending Future Land Use for Parcel ID 31-20-30-300-0010-0000ORDINANCE NO. 16-2109 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 03-16) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM CITY CONSERVATION (CON) TO CITY OF LONGWOOD LOW DENSITY RESIDENTIAL (LDR) FOR A PORTION OF THE PROPERTY WITH PARCEL ID 31-20-30-300-0010- 0000; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida Administrative Code; and WHEREAS, Chris and Larry Belair have requested a change to the future land use and zoning designation for properties located within the City of Longwood, described in Section I; and WHEREAS, such properties should be consistent with land uses of neighboring parcels to allow for the most appropriate future development of the site; and WHEREAS, such designations should ensure that areas of conservation value are protected from development; and WHEREAS, the applicant Chris and Larry Belair have provided a legal description based on an field meeting with a St. Johns Water Management District field biologist defining the extent of the new conservation boundary; and WHEREAS, the proposed future land use and zoning classification (LDR) for the property is consistent with City of Longwood Comprehensive Plan and its goals, policies and objectives; and Ordinance No. 16-2109 Page 1 of 5 WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing on December 14, 2016 to consider the Small Scale Plan Amendment request; and recommended the proposed Small Scale Plan Amendment (SPA 03-16) be approved by the City Commission; and WHEREAS, the City Commission held an initial first reading on December 19, and a public hearing on January 16, 2017 pursuant to the requirements of Chapter 163.3187, FS. WHEREAS, the City Commission of the City of Longwood, Florida has held a public hearing with due public notice to consider the FLU and zoning map amendments of the property hereinafter described and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Longwood future land use and zoning designation were heard WHEREAS, the Small Scale Plan Amendment adopted by this Ordinance is internally consistent with the City of Longwood Comprehensive Plan and its goals, policies and objectives; and BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION I: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the property described as: Property ID#: 31-20-30-300-0010-0000 as depicted in EXHIBIT A, from CITY CONSERVATION (CON) TO CITY OF LONGWOOD LOW DENSITY RESIDENTIAL (LDR) FOR A PORTION OF Ordinance No. 16-2109 Page 2 of 5 THE PROPERTY WITH PARCEL ID 31-20-30-300-0010-0000, attached hereto as though fully contained herein. SECTION H. Codification: It is the intention of the City Commission of the City of Longwood, Florida and it is hereby ordained that the provisions of the Ordinance shall become and be made a part of the City of Longwood, Florida adopted zoning map. SECTION M. Conflicts: If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. SECTION IV. Severability: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this Ordinance. SECTION V. Effective Date: This Ordinance shall become effective 31 days after adoption if no timely challenge is filed. If timely challenged, this Ordinance shall become effective as provided in the applicable provisions of Chapter 163, Part H, Florida Statutes. FIRST PUBLIC HEARING 19' day of December, 2016.
