17-1440 Adoption of a Landscape Construction and Maintenance Agreement with FDOT
RESOLUTION NO.17-1440 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, REGARDING THE ADDOPTION OF A LANDSCAPE CONSTRUCTION AND MAINTENANCE AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION WHEREAS, the FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) has jurisdiction over and maintains State Road 434 as part of the State Highway System; and WHEREAS, the CITY OF LONGWOOD seeks to install and maintain certain landscaping within the right of way of State Road 434; and WHEREAS, FDOT agrees to allow the landscaping only under certain conditions necessary to protect the traveling public using said right of way; and WHEREAS, Rule 14-40.003, Florida Administrative Code, requires the parties to enter into an Agreement designating and setting forth the responsibilities of each party. WHEREAS, the CITY OF LONGWOOD has authorized its officers to execute this AGREEMENT (Exhibit "A") on its behalf. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Longwood, Florida, as follows: Section I: The Longwood City Commission ("the Commission") hereby accepts the attached Agreement (Exhibit "A") and authorizes the City Manager or designee to sign all documents necessary to execute the agreement. Section II: The Agreement, provided by FDOT, references the Landscape Plan, Landscape Maintenance Plan, and Maintenance of Traffic Plan, as separate exhibits. For the purposes of this resolution, those documents are provided as one document (Exhibit `B"). Section III: The Commission hereby directs that a certified copy of this Resolution shall be forwarded forthwith to FDOT. Section IV: This Resolution shall become effective upon its adoption by the Commission.
