A RESOLUTION OF THE CITY OF LONGWOOD,
FLORIDA, EXTENDING THE TEMPORARY BACKYARD
CHICKEN PILOT PROGRAM CREATED BY ORDINANCE
NO. 16-2092 TO SEPTEMBER 30, 2018; PROVIDING FOR
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, on August 15, 2016, the City Commission adopted Ordinance No. 16-2092
creating a temporary backyard chicken pilot program which sunsets and expires on February 28,
2018; and
WHEREAS, Section 7 of Ordinance No. 16-2092 provides that the City Commission
may extend the sunset and expiration of Ordinance No. 16-2092 and the temporary backyard
chicken pilot program created thereby by ordinance or resolution; and
WHEREAS, the City Commission desires to retroactively extend the sunset and
termination date of Ordinance No. 16-2092 and the temporary backyard chicken pilot program
created thereby until September 3, 2018.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF LONGWOOD AS FOLLOWS:
SECTION 1. Authority/Findings. The City of Longwood has the authority to adopt
this Resolution pursuant to Article VIII of the Constitution of the State of Florida, the City of
Longwood Charter, and Chapters 163 and 166, Florida Statutes. The "Whereas" clauses set forth
above and in Ordinance No. 16-2092 shall constitute the legislative findings of the City
Commission of the City of Longwood.
SECTION 2. Extension. The sunset and expiration date set forth in Section 7 of
Ordinance No. 16-2092 is hereby retroactively extended to September 30, 2018. Thus,
Ordinance No. 16-2092 has not sunset and expired and will not until September 30, 2018 unless
further extended by ordinance or resolution.
SECTION 3. Severability. The provisions of this Resolution are declared to be
separable and if any section, paragraph, sentence or word of this Resolution or the application
thereto any person or circumstance is held invalid, that invalidity shall not affect other sections
or words or applications of this Resolution. If any part of this Resolution is found to be
preempted or otherwise superseded, the remainder shall nevertheless be given full force and
effect to the extent permitted by the severance of such preempted or superseded part.
SECTION 4. Effective Date. This Resolution shall take effect immediately upon the
adoption.
