Present: Amy Goodblatt, Special Magistrate Chris Conley, City Attorney Also Present: Brittany Kidd Gelm, Code Compliance Officer 1. CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 9:00 a.m. 2. APPROVAL OF THE MINUTES FROM THE September 26, 2019 HEARING: Special Magistrate Goodblatt approved Minutes from the September 26, 2019 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. 4. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. S. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. 6. PUBLIC HEARINGS: A. CEH 19-10-1504 CC, Chapter 38 Section 38-121 Trash & Debris Dorman, Jeremy 151 Columbus Circle Longwood, FL 32750 CEO Gelm introduced herself and presented evidence and the Cost Recovery Worksheet to the Special Magistrate. The Respondent/Property Owner was not present. CEO Gelm stated that this property is in violation of CC, Chapter 38 Section 38-121 Trash & Debris. This property is in violation because there is tree debris in the front yard from a fallen tree branch. A Notice of Violation was issued on 8/27/19 and posted at the property. The mailing address for the property owner is this address. The Notice of Violation was also sent to The Mortgage Firm, Inc. and was accepted service on 10/21/19. A Notice of Hearing was issued on 10/16/19 and certified mailed to the property owner. The Special Magistrate made inquiry of the Code Compliance Officer. The Special Magistrate made her findings in that service was properly made. A public nuisance exists at the cited property due to an accumulation of tree debris, past the date set for compliance. In order to come into compliance, the tree debris must be removed. Should the property not come into compliance within 15 days from date of service of the Order, Respondent shall pay a fine of $20.00 per day for each day the violation continues to exist beyond the date set for compliance. Respondent shall pay an administrative cost of $235.95 within 30 days of receipt of Final Orders. B. CEH 19-11-1514 CC, Chapter 38 Section 38 (1-6) Nuisance Investor Trustee Services, LLC 401 Columbus Circle Longwood, FL 32750 CEO Gelm introduced herself and presented evidence and the Cost Recovery Worksheet to the Special Magistrate. The Respondent/Property Owner was not present. CEO Gelm stated that this property is in violation of CC, Chapter 38 Section 38 (1-6) Nuisance. This property is in violation because there is a large bee hive in a tree on the property. The bees are swarming and are a hazard to the neighbor as the tree is right next to her driveway. A Notice of Violation was issued on 10/4/19 and certified mailed to the property owner and registered agent. A Notice of Hearing was issued on 10/21/19 and certified mailed to the property owner and registered agent. The Notice of Hearing was delivered to the property owner on 10/22/19. The Notice of Hearing was delivered to the registered agent on 10/23/19. On 10/30/19 CEO Gelm received an email from Hope Richards of Reifkind, Thompson and Rudzinski Law Firm advising they had hired someone to remove the bees and fill in the tree and that the property was now in compliance. CEO Gelm completed a re -inspection 10/31/19 and found the bees were still swarming around the tree and advised Ms. Richards of such. The Special Magistrate made inquiry of the Code Compliance Officer. The Special Magistrate made her findings in that service was properly made. The Respondent Property Owner is guilty of violating CC, Chapter 38 Section 38 (1-6) Nuisance. In order to come into compliance, Respondent must have the bees and hive, if applicable, removed from the property. Should the property not come into compliance within five days from date of service of the Order, Respondent shall pay a fine in the amount of $100.00 per day for each day the violation continues to exist beyond the date set for compliance. Respondent shall pay an administrative cost of $247.90 within 30 days of receipt of Final Orders. CEH 19-09-1491R CC, Chapter 18 Section 18-221 Outdoor Storage Williams, Barbara -Trustee 621 E Wildmere Avenue Longwood, FL 32750 CEO Gelm introduced herself and presented evidence and the Cost Recovery Worksheet to the Special Magistrate. The Respondent/Property Owner was not present. CEO Gelm stated that this property is in violation of CC, Chapter 18 Section 18-221 Outdoor Storage as a Repeat Violator. This property was brought before the Special Magistrate on September 26, 2019 and was found guilty for this same violation. This property is in violation because there are misc. items and household furniture scattered in the back yard. A Notice of Violation was issued on 10/1/19 and certified mailed to the property owner. On 10/7/19 the Notice of Violation was First Class Mailed to the property owner. A Notice of Hearing was issued on 10/23/19 and certified mailed to the property owner. The Notice of Hearing was delivered on 10/25/19. A neighbor, Nancy McLarnon, provided testimony as a witness for the City regarding the Outdoor Storage and other general complaints about the property. Another neighbor, Stan Pelz, provided testimony as a witness for the City regarding the on -going nuisance at this property. The Special Magistrate made inquiry of the Code Compliance Officer. The Special Magistrate made her findings in that service was properly made on the Respondent Property Owner. The Respondent was previously found in violation of this Code Section in an Order, stated verbally by the Magistrate at an official Code Enforcement Hearing on September 26, 2019 and memorialized in an Order dated and served on October 17, 2019. The Respondent is guilty of violating CC, Chapter 18 Section 18-221 Outdoor Storage as a Repeat Offender. In order to come into compliance, all items stored outdoors must be removed from the property. Respondent shall pay a fine of $250.00 per day retroactive to October 17, 2019 and will continue to accrue each day the violation continues to exist until the property comes into compliance. Respondent shall pay an administrative cost of $235.45 within 30 days of receipt of Final Orders. 7. REPORTS -CASE UPDATES None. 8. UNFINISHED BUSINESS None. NEW BUSINESS A. The December Special Magistrate Meeting will be cancelled due to the Holidays. 11.
