20-1520 Amends Employees Pay Policy During City Declared EmergencyRESOLUTION NO. 20-1520 A RESOLUTION OF THE CITY OF LONGWOOD, FLORIDA AMENDING THE PAY POLICY FOR EMPLOYEES DURING A CITY DECLARED EMERGENCY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission previously adopted Resolution No. 19-1503 a policy for pay for employees during a declared emergency, and this Resolution is intended to replace said resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: Section I: That the following be established for pay during a City declared emergency. Upon adoption of an Emergency Ordinance declaring a City emergency and adopting emergency regulations in accordance with the City of Longwood City Code, the City will cease normal operations and divert efforts towards preparation and recovery. The City's employees must be prepared at all times to respond to disaster situations that may affect the residents of the City. Unless otherwise directed, City employees are required to report for duty during disaster operations as directed by their Department Head. Those employees who are vital and necessary to the continued operations of the City of Longwood during a declared emergency shall be designated as assigned personnel. All employees inclusive of sworn police and fire will be paid in accordance with the City's Human Resources Rules and Regulations, Policies and Procedures, and Collective Bargaining Agreements (CBAs), and in addition, will be covered by the provisions outlined below. If a conflict arises between this Policy and a relevant CBA, the CBA will be applicable. Compensation of Declared Emergency Standard Pay (DESP) is only applicable from the declaration of the City emergency to the reopening of City operations. Declared Emergency Standard Pay are pre -budgeted payroll dollars, based on the employee's normally scheduled shift; these standard hours are paid to all employees (including sworn police and fire) who have been instructed not to report to work and also to assigned personnel who are required to report to work when the City Manager or designee has declared all offices and departments officially closed. The Declared Emergency periods begin once the City Manager or designee announces a Declared Emergency closing the City for normal business and ends when the City Manager or designee declares it appropriate for all employees to return to work. The following compensation procedures will apply during a City Declared Emergency when the City is closed: 1. When a City emergency is declared and employees are scheduled off on vacation, sick leave or other approved absence, they will not be given or allocated any hours Resolution No. 20-1520 Page 1 of 3 or extra time as they were not scheduled to be on -duty during the City declared emergency. 2. All employees, who are released from work prior to the completion of their scheduled shift will suffer no loss in pay (employee timesheet will reflect normal scheduled hours). Employees will account for their time by reporting hours as DESP. 3. If the City operations cease for entire day(s), all employees, (including sworn police & fire) will be paid DESP to reflect their standard scheduled hours. Employees will receive DESP when the City is closed under a state of emergency. Once the City reopens, and is no longer under a state of emergency, employees are required to return to their scheduled shifts. If it is determined by the City Manager that certain employees are unable to return to work, those employees unable to return may use any available accrued leave hours for their continued absence. 4. Declared Emergency Standard Pay (DESP) counts as hours worked for computing premium (time and one-half) overtime eligibility. 5. Hourly (non-exempt) employees who are assigned and must remain on duty to support City emergency operations shall be paid DESP for the hours they would normally be scheduled to work, and in addition, hourly employees will be compensated at their regular rate of pay for hours actually worked (inclusive of rest periods) in accordance with City policy and the Fair Labor Standards Act and in accordance with the City Personnel and Policy Manual, and Collective Bargaining Agreements. 6. Employees who work during a City declared emergency when it is not their scheduled workday will be paid only for hours worked in accordance with City policy and the Fair Labor Standards Act and in accordance with the City Personnel and Policy Manual and Collective Bargaining Agreements. 7. All salaried (exempt) employees, including Fire Battalion Chiefs who are assigned to work as a direct result of a declared emergency shall be paid DESP to reflect their normal standard scheduled hours, and in addition, will be compensated for additional hours worked (inclusive of rest periods) at a straight hourly rate. Once a department returns to normal work schedule, all pay returns to normal FLSA rules, City policy, City Personnel and Policy Manual, Collective Bargaining Agreements, and standard payroll procedures. The City Manager or designee reserves the right to consider unique pay situations as they arise throughout the Declared Emergency Periods and may make exceptions in situations deemed appropriate. Resolution No. 20-1520 Page 2 of 3 Timeframes for promotions, grievances and disciplinary actions may be suspended until the Declared Emergency is no longer in effect and employees have returned to their normal duties and responsibilities. Section II: Conflicts. In the event of any conflicts between this Resolution and any other resolution, this Resolution shall control to the extent of the conflict. This Resolution replaces Resolution No. 19-1503. Section III: This Resolution shall take effect immediately upon passage and adoption. The foregoing recitals (whereas clauses) are incorporated herein by reference and adopted in support of the matters set forth in this Resolution and made part hereof.
