20-1522 City's Withdrawal From Public Risk Management of Florida Insurance PoolRESOLUTION NO. 20-1522 A RESOLUTION OF THE CITY OF LONGWOOD, FLORIDA, PROVIDING FOR THE CITY'S WITHDRAWAL FROM THE PUBLIC RISK MANAGEMENT OF FLORIDA INSURANCE POOL AND DIRECTING THAT NOTICE BE SENT TO PUBLIC RISK MANAGEMENT OF FLORIDA REGARDING THE NON -RENEWAL OF THE CITY'S INSURANCE POLICY WITH SAME; PROVIDING FOR CONFLICTS, CODIFICATION, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Longwood ("City") currently is a member of the insurance pool and is otherwise covered by an insurance policy issued by Public Risk Management of Florida ("PRM"); and WHEREAS, pursuant to the existing insurance policy, the City may withdraw from the insurance pool and otherwise elect not to renew its insurance policy with PRM through a notice of withdrawal directed to the Executive Director of PRM and further that such notice shall be accompanied by a resolution of the governing body of the insured electing to withdraw from the insurance pool; and WHEREAS, the City desires to withdraw from the insurance pool and seek insurance with and through entities other than PRM at the conclusion of the fiscal year ending on September 30, 2020, and further directs that City staff provide appropriate notice of withdrawal to PRM as set forth in the insurance policy. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA: Section 1. Legislative Findings and Purposes. The preceding recitals are hereby adopted as the legislative findings of the City Commission of the City of Longwood and are incorporated into this Resolution as if set forth herein. Section 2. Election of Withdrawal; Notice. The City hereby elects to withdraw from the insurance pool as set forth in the PRM insurance contract and bylaws at the end of the fiscal year ending September 30, 2020. City staff is directed to prepare a notice of withdrawal from the insurance pool and policy issued by PRM within the timeframes and in such manner as otherwise set forth in the existing insurance contract. A copy of this Resolution shall accompany said notice. Section 3. Severability. Resolution No. 20-1522 Page 1 of 2 If any section, subsection, sentence, clause, phrase, or potion of this Resolution, or application hereof, is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion or application shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion thereof to the extent practicable. Section 4. Conflicts. To the extent this Resolution or any provisions thereof conflict with any previously enacted resolution of the City of Longwood, then this Resolution shall control only to the extent any such conflict(s) exists. Section 5. Effective Date. This Resolution shall take effect immediately upon adoption. ADOPTED this 17th day of February 2020.
