L Special Magistrate Amy Goodblatt called the meeting to order at 9:00 a.m. APPROVAL OF THE MINUTES FROM THE November 5, 2019 HEARING: Special Magistrate Goodblatt approved Minutes from the November 5, 2019 meeting. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. CEH 2O-01-1521 LDC, Article X Section 10.1.0 Construction Permit Cerberus Holdings LP 161 Sheridan Avenue Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery to the Special Magistrate. The Respondent/Property Owner was not present. CEO Gelm stated that this property is in violation of LDC, Article X Section 10.1.0 Construction Permit. This property is in violation because Permit 2018-00616 for A/C replacement expired without a final inspection. A Notice of Violation was issued on 10/31/19. The NOV was delivered on 11/4/19. A Notice of Hearing was issued on 11/20/19. The NOH was delivered on 11/26/19. The Special Magistrate made her findings in that service was properly made. The Respondent/Tenant Greg Brown was present. CEO Gelm stated that this property is in violation of LDC, Article X Section 10.1.0 Construction Permit. This property is in violation because Permit 2018-01463 for A/C replacement expired without successfully passing the final inspection. A Notice of Violation was issued on 11/11/19. The NOV was delivered 11/19/19. A Notice of Hearing was issued on 12/12/19. The NOH was delivered on 12/18/19. Respondent Greg Brown testified that he is the tenant of the cited property. He understands why the final inspection from 1/22/2020 failed and it has been corrected as of today, 2/23/2020. The Special Magistrate made inquiry of the Code Compliance Officer. The Special Magistrate made her findings in that service was properly made on the Respondent Property Owner. The Respondent failed to fulfill the terms of its construction permit to replace the A/C as it did not call for a final inspection either prior to or after the permit expired. In order to come into compliance, Respondent must contact the City of Longwood Building Department to schedule a final inspection. The property must pass the final inspection, which includes labeling the A/C unit. Should the property not come into compliance within 5 days from date of service of the Order Respondent shall pay a fine of $20.00 per day for each day the violation continues to exist beyo d the date set for compliance. The Respondent/Property Owner was not present. CEO Gelm stated that this property is in violation of LDC, Article X Section 10.1.0 Construction Permit. This property is in violation because Permit 2018-01420 for a generator and concrete pad expired without a final inspection. A Notice of Violation was issued on 11/11/19. The NOV was delivered on 11/15/19 A Notice of Hearing was issued on 12/5/19. The NOH was delivered on 12/9/19. The Special Magistrate made inquiry of the Code Enforcement Officer. The Special Magistrate made her findings in that service was properly made. The Respondent failed to fulfill the terms of its construction permit by not calling for and passing a final inspection prior to the expiration of the permit. In order to come into compliance, Respondent must contact the JA� City of Longwood Building Department to schedule a final inspection. The property must pass the Y� final inspection. The Respondent/Property Owner was not present. CEO Gelm stated that this property is in violation of CC, Chapter 38 Section 38-141 High Grass & Weeds, CC, Chapter 38 Section 38-121 Trash & Debris, and CC, Chapter 18 Section 18-221 Outdoor Storage. This property is in violation because there are misc. items being stored in the driveway, misc. trash in the driveway and the property is not being mowed and maintained on a regular basis. A Notice of Violation was issued on 11/15/19. The NOV was First Class Mailed to the property owner on 11/27/19. A Notice of Hearing was issued on 12/6/19. The NOH was delivered on 12/9/19. The Special Magistrate made her findings in that service was properly made. A nuisance was created on the property located within 100 feet of improved properties in the City of Longwood due to tall grass and weeds and an accumulation of trash, furniture and debris in the front of the property. The property is so unsightly that it negatively impacts adjacent property owner's land values. The condition of the property is such that it is, or may become infested with rodents, vermin or it may furnish a breeding ground for mosquitos. The furniture stored in the driveway violates the outdoor storage section of the code. In order to come into compliance, Respondent must remove all furniture and all items from the driveway. Remove all trash and tree debris from the property. The property must be mowed and weeded on a regular basis. Should the property not come into compliance within 10 days from date of service of the Order, Respondent shall pay a fine of $75.00 per day for each day the violation continues to exist beyond the date set for compliance. Respondent shall pay an administrative cost of $235.45 within 30 days of receipt of Final Orders. CEH 2O-01-1528 CC, Chapter 18 Section 18-63 Minimum Property Standards Owings, Douglas 277 Tullis Avenue Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery to the Special Magistrate. The Respondent/Property Owner was present. CEO Gelm stated that this property is in violation of CC, Chapter 18 Section 18-63 Minimum Property Standards. This property is in violation because the roof on the back side of the house is rotted, the porch on the back side of the house is falling down, there is rotted wood on the front of the house and near the garage door and there are broken windows on the back porch. A Notice of Violation was issued on 10/22/19. A Notice of Hearing was issued on 12/10/19. The NOH was First Class Mailed on 12/26/19. The NOH was posted at the property and City Hall on 1/3/2020. Phil Kersey, City Building Official, testified about the condition of the property and safety concerns. The property owner, Douglas Owings, provided testimony that he has lived at the property for 38 years. The hurricane further damaged the property. He currently cares for his mother and doesn't have time to repair the property. The new purchaser will fix the violations. The purchaser, Tom Evans, testified he will pull permits 1/24/2020. He was advised he cannot pull the permit if the title is changing. He requested he be given until Monday, January 27, 2020, for a contractor to pull the permit and 14 days thereafter to make all repairs except for the roof. The Special Magistrate made inquiry of the Code Enforcement Officer, Respondents and witnesses. The Special Magistrate made her findings in that service was properly made. The subject property fails to meet Minimum Property Standards, as it is unsafe for use or occupancy. The structure is CEH 01-23-2020 Page 4 of 6 CODE ENFORCEMENT HEARING City Commission Chambers 175 West Warren Avenue Longwood, FL 32750 not secure and the porch's roof is rotted and supported by a carjack. There is also rotted wood on the roof and at the front of the house. There are broken windows on the back porch, and the back door is falling off. The property is in great disrepair. In order to come into compliance, Respondent must obtain a demolition permit for the back porch from the City. Remove the porch and pass all of the requirements of the permits. Secure permits to repair the broken windows. Replace the rotted wood and repair the door. Pass all required inspections. The roof is to be repaired. Should the property not come into compliance by or before January 27, 2020 by obtaining permits, and by completing the word and passing all inspections by February 10, 2020, the City will be permitted to enter the property to demolish the porch and fence, and to fence the property. Cost of demolition and repairs will then be assessed to the homeowner. Respondent shall pay an administrative cost of $235.95 within 30 days of receipt of Final Orders. G.
