A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
LONGWOOD DELEGATING THE TEMPORARY USE PERMIT WAIVER
AUTHORITY IN CITY CODE SECTION 58-194 TO THE CITY MANAGER
IN ORDER TO HELP SUPPORT BUSINESSES DURING THE COVID-19
PANDEMIC.
WHEREAS, Longwood's business community has been dramatically impacted by the
COVID-19 pandemic, resulting in the closure and reduction of operation of many of the City's
businesses; and
WHEREAS, the survival of Longwood's businesses is greatly important to the City, its
residents, and will be integral to the recovery efforts of the City and its residents; and
WHEREAS, City Code Section 58-194 allows the City Commission to waive or modify any
provision of City Code Chapter 58, Article IV Temporary Uses; and
WHEREAS, the City Commission desires to delegate that authority to the City Manager on
a temporary basis to deal with the impacts of the COVID-19 Pandemic on the Longwood business
community; and
WHEREAS, Temporary Use Permits are typically utilized to facilitate larger gatherings than
a site is typically designed for, the utilization of this authority is intended not to encourage
gatherings but to efficiently facilitate the creative use of space and signage to help support
business and property owners in the City during a crisis; and
WHEREAS, the delegation of this authority allows the City Manager to modify deadlines,
uses, and other related regulations in Chapter 58, Article IV as needed to most effectively support
the business community; and
WHEREAS, the Longwood City Commission finds that this Resolution is in the best interest
and welfare of the residents of the City of Longwood.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
LONGWOOD, FLORIDA, AS FOLLOWS:
Section 1. That City Commission temporarily delegates the authority granted to the City
Commission in Section 58-194 to the City Manager with the intent that the City Manager, or their
designee, utilize the authority to permit creative private sector solutions to help businesses
during this crisis, while maintaining the safety of the public. Where Temporary Use Permits are
typically site -specific, the City Manager may approve city-wide Temporary Use Permits where
such action is deemed in the best interest of Longwood residents and business owners.

Section 2. The City Commission authorizes the waiver of all fees related to Temporary Use
Permits granted under this authority.
Section 3. Any temporary use permit approved under this delegation of authority will
expire no later than 7 days after the expiration of the Governor's State of Emergency declaration
(Executive Order 20-52), or as specified on the Temporary Use Permit.
Section 4. The delegation of authority to the City Manager shall terminate and revert back
to the City Commission upon the expiration of the State of Emergency declaration by the
Governor of Florida, unless the delegation is rescinded or extended by a vote of the City
Commission.
Section S. Recitals. The above recitals are true and correct and are incorporated herein
by this reference.
Section 6. Effective Date. This Resolution shall take effect immediately upon adoption.
