CALL MEETING TO ORDER. Special Magistrate Amy Goodblatt called the meeting to order at 9.00 a m 2. APPROVAL OF THE MINUTES FROM THE August 27, 2020 HEARING. Special Magistrate Goodblatt approved Minutes from the August 27, 2020 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS. Special Magistrate Goodblatt explained the hearing process for the attendees. 4. ROLL CALL OF SCHEDULED CASES. Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. 5. SWEARING IN OF ALL WITNESSES. Special Magistrate Goodblatt swore in all witnesses. 6. PUBLIC HEARINGS. A. CEH 20-08-1575 LDC,Article IX Section 9 1.5 Nonconforming Use 's. BRW Holdings—P/O The Booze Thru 205 S HWY 17-92 Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery to the Special Magistrate The Respondent/Property Owner Vince Wolle of BRW Holdings and Tracy Craddock of The Booze Thru were present. Marie Regan, Planner for the City of Longwood was also present. CEH 09-24-2020 Page 1 of 4 CODE ENFORCEMENT HEARING City Commission Chambers 175 West Warren Avenue Longwood, FL 32750 CEO Gelm stated that this property is in violation of LDC, Article IX Section 9 1.5 Nonconforming Use This property is in violation because the business has not submitted all required documents to complete their site construction permit. A Notice of Violation was issued on 3/4/2020 and certified mailed to the property owner On 3/5/2020 the NOV was First Class Mailed to the tenant.The NOV was delivered to the property owner on 3/6/2020 A Notice of Hearing was issued on 8/18/2020 and certified mailed to the tenant and property owner The NOH was delivered to the property owner and tenant on 8/20/2020 Marie Regan provided testimony about what specifically needed to be done to bring the property into compliance Tracy Craddock, Owner of The Booze Thru provided testimony that the City's recitation of events was correct and the City has been patient with her She advised there was an issue with the survey which delayed the whole process. Special Magistrate made inquiry of the Code Compliance Officer, City Planner and Respondents. The Special Magistrate made her findings in that service was properly made Respondents failed to fulfill the necessary documentation for its site construction permit as required by the Land Development Code after the date set for compliance In order to come into compliance, Respondents must submit all required documents to the City to obtain a site construction permit. The list of requirements is in the correspondence submitted into evidence dated December 10,2019 and August 10,2020 Respondents must pass any and all required inspections. Respondent shall jointly and severally pay an administrative cost of $240.25 within 30 days of receipt of Final Orders. If Respondents do not comply by October 15,2020 by submitted all documentation to complete the permit application and by finishing the work and passing all required inspections within 30 days thereafter, Respondents,jointly and severally,shall pay a fine of$125 00 per day until compliance is met. B CEH 20-09-1585 CC, Chapter 18 Section 18-63 Min Property Standards Ragoonanan, Mark& Lynette 569 E Magnolia Ave Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery to the Special Magistrate. The Respondent/Property Owner was not present. Phil Kersey, Building Official for the City of Longwood was present. Property Standards because the front porch on the property is collapsing and there are several broken windows. A Notice of Violation was issued on 7/2/2020 and certified mailed to the property owner The NOV was delivered on 7/13/2020 Respondent/Property Owner advised the City that he would apply for a demolition permit by August 18,2020, however, he did not. A Notice of Hearing was issued on 8/18/2020.The NOH was delivered on 8/24/2020. Building Official Phil Kersey provided testimony as a witness for the City Special Magistrate made inquiry of the Code Compliance Officer and Building Official The Special Magistrate made her findings in that service was properly made.The property fails to meet Minimum Property Standards in that its structures are dangerous in their present condition. The roof structure is collapsing over the carport and has already collapsed over the porch. Windows are broken throughout the property The room at the backside is collapsing due to a failing foundation If the Respondents do not comply within 5 days of receipt of the Final Orders, by applying for a demolition permit and by demolishing the property and passing inspections within 30 days thereafter, Respondents shall pay a fine in the amount of$100.00 per day until compliance is met. Respondent shall pay an administrative cost of $251.76 within 30 days of receipt of Final Orders. C.
