20-2176_Failed Small Scale Comprehensive Plan for 1800 Lake Emma Road avAv6 kcass fi r.S4- ORDINANCE NO. 20-2176 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 01-20) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM COUNTY LOW DENSITY RESIDENTIAL (LDR) TO CITY OF LONGWOOD MEDIUM DENSITY RESIDENTIAL (MDR) AND COUNTY ZONING FROM AGRICULTURAL (A-1) TO CITY OF LONGWOOD MEDIUM DENSITY RESIDENTIAL 15 (MDR-15) TO THE PROPERTY WITH PARCEL ID 30-20-30-300-007G- 0000; PROVIDING FOR CODIFICATION,CONFLICTS,SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida Administrative Code; and WHEREAS, Lake Emma Properties, LLC on behalf of property owner Ohri-Gul, LLC has requested a small scale land use amendment pursuant to annexation of the said property now located within the City of Longwood, described in Section I; and WHEREAS, such properties should be consistent with land uses of neighboring parcels to allow for the most appropriate future development of the site; and WHEREAS, the proposed future land use and zoning classification (MDR & MDR-15) for the property is consistent with City of Longwood Comprehensive Plan and its goals, policies and objectives; and WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and Ordinance No.20-2176,SPA 01-20 Page 1 of 5 WHEREAS, the LPA held a public hearing on August 12, 2020 to consider the Small Scale Plan Amendment request; and recommended the proposed Small Scale Plan Amendment (SPA 01-20) be approved by the City Commission; and WHEREAS, the City Commission held an initial reading on August 24, 2020 and a public hearing on September 10, 2020 pursuant to the requirements of Chapter 163.3187, FS. WHEREAS, the City Commission of the City of Longwood, Florida has held a public hearing with due public notice to consider the future land use and zoning map amendments of the property hereinafter described and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Longwood future land use and zoning designation were heard; and WHEREAS, the Small Scale Plan Amendment adopted by this Ordinance is internally consistent with the City of Longwood Comprehensive Plan and its goals, policies and objectives. BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA,AS FOLLOWS: SECTION I: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the property described as: Property ID#: 30-20-30-300-007G-0000 as depicted in EXHIBIT A,from CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM COUNTY LOW DENSITY RESIDENTIAL(LDR)TO CITY OF LONGWOOD MEDIUM DENSITY RESIDENTIAL (MDR) AND COUNTY ZONING FROM Ordinance No.20-2176,SPA 01-20 Page 2 of 5 AGRICULTURAL (A-1) TO CITY OF LONGWOOD MEDIUM DENSITY RESIDENTIAL 15 (MDR-15) attached hereto as though fully contained herein. SECTION II. Codification: It is the intention of the City Commission of the City of Longwood, Florida and it is hereby ordained that the provisions of the Ordinance shall become and be made a part of the City of Longwood, Florida adopted land use and zoning map. SECTION III Conflicts: If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. SECTION III. Severability: If any section or portion of a section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or part of this Ordinance. SECTION IV. Effective Date: This Ordinance shall become effective 31 days after adoption if no challenge is filed. If timely challenged, the Ordinance will become effective as provided by general law. FIRST READING this 24th day of AUGUST 2020. PUBLIC HEARING this 10th day of SEPTEMBER 2020.
