CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 9:00 a.m. 2. APPROVAL OF THE MINUTES FROM THE September 23,2021 HEARING: Special Magistrate Goodblatt approved Minutes from the September 23,2021 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. 4. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. 5. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. 6. PUBLIC HEARINGS: A. CEH 21-10-1704 LDC,Art.X Sec. 10.1.0 Construction Permit Longwood Commerce Park LLC 1275 Bennett Drive Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery document to the Special Magistrate. Respondent,Jamie Estepp,was present. CEO Gelm stated that this property is in violation of LDC,Art.X Sec. 10.1.0 Construction Permit because the parking lot was being re-striped without a permit. A Notice of Violation was issued on 9/17/2021 and mailed via certified mail to the property owner.The NOV was delivered to the property owner 9/20/2021. CEH 10-28-2021 Page 1 of 3 CODE ENFORCEMENT HEARING City Commission Chambers 175 West Warren Avenue Longwood, FL 32750 A Notice of Hearing was issued on 9/30/2021 and mailed via certified mail to the property owner.The NOH was First Class Mailed, as well as posted at the property and Longwood City Hall on 10/12/2021. Phil Kersey, the City of Longwood Building Official provided testimony that re-striping requires a permit. The City Attorney advised as to the section of the LDC that requires a permit to re-stripe. Respondent,Jamie Estepp,testified on behalf of the property management company.She advised it should only take about two weeks to apply for the permit. A contract for re- striping was submitted into evidence. It showed that concrete work will also be done, which also requires a permit. Special Magistrate made inquiry of the Code Compliance Officer and Respondent. The Special Magistrate made her findings,that development activity was undertaken at the cited property without a permit. Re-striping a parking lot constitutes development activity. In order to come into compliance, the Respondent/Property Owner must hire a licensed contractor to obtain a permit for striping the lot and the concrete replacement. All required inspections must be completed and approved. If the Respondent does not comply by November 30, 2021 by obtaining the permit and by asking for,and passing,all required inspections by March 1, 2022, Respondent shall pay a fine of$150.00 per day each day the violation continues to exist beyond the date set for compliance.Respondent must pay an Administrative Fine of$281.24 within 30 days of receipt of Final Orders. 7. REPORTS-CASE UPDATES None. 8. UNFINISHED BUSINESS A. Special Magistrate signed the Order to Impose CEH 21-07-1670 in reference to 968 W SR 434 and reduced the outstanding fine to$1,000.00 which includes the previously imposed Administrative Fine. 9. NEW BUSINESS The November Special Magistrate Hearing has been rescheduled to November 17, 2021 at 9:00am in the City of Longwood Commission Chambers due to the original date falling on Thanksgiving Day. 11.
