21-2216 Amending Future Land Use SPA 05-21ORDINANCE NO. 21-2216 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 05-21) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM CITY OF LONGWOOD INDUSTRIAL (IND) TO CITY OF LONGWOOD INFILL AND MIXED USE (IMU) TO THE PROPERTIES WITH PARCEL ID'S 06-21-30-502-OROD-0000 AND 06-21-30-502-OROC-0000; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida Administrative Code; and WHEREAS, American Muslim Community Centers Inc., has requested a small-scale land use amendment to amend the City's future land use map for Parcel ID's 06-21-30-502-OROD- 0000 and 06-21-30-502-OROC-0000 already located within the City of Longwood, described in Section I; and WHEREAS, the use, a Community Center, is currently a legally nonconforming use on the 811 Wilma parcel and therefore per City's Land Development Code (LDC) Article IX, Section 9.1.1.1, cannot be increased, enlarged or intensified; and WHEREAS, American Muslim Community Centers Inc., would like to change the land use from Industrial (IND) to Infill and Mixed Use (IMU) which would allow the current use to potentially expand; and WHEREAS, the proposed future land use Infill and Mixed Use (IMU) for the properties is consistent with City of Longwood Comprehensive Plan and its goals, policies and objectives; and Ordinance No. 21-2216 SPA 05-21 Page 1 of 5 WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing on January 12, 2022 to consider the Small -Scale Plan Amendment request; and recommended the proposed Small -Scale Plan Amendment (SPA 05-21) be approved by the City Commission; and WHEREAS, the City Commission held an initial reading on February 7, 2022 and a public hearing on February 21, 2022 pursuant to the requirements of Chapter 163.3187, FS. WHEREAS, the City Commission of the City of Longwood, Florida has held a public hearing with due public notice to consider the future land use and zoning map amendments of the property hereinafter described and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Longwood future land use and zoning designation were heard; and WHEREAS, the Small -Scale Plan Amendment adopted by this Ordinance is internally consistent with the City of Longwood Comprehensive Plan and its goals, policies and objectives. BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION I: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the properties described as: Property ID#s: 06-21-30-502-OROD-0000 and 06-21-30-502-OROC-0000 as depicted in EXHIBIT A, CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM CITY OF LONGWOOD INDUSTRIAL (IND) TO CITY Ordinance No. 21-2216 SPA 05-21 Page 2 of 5 OF LONGWOOD INFILL AND MIXED USE (IMU) attached hereto as though_ fully contained herein. At the time of adoption of this Ordinance, the City is presently considering changes to = the Comprehensive Plan and Land Development Code to establish a "Commercial' Future Land Use with a "General Commercial' zoning category that would replace some areas designated as. "Infill and Mixed -Use." Should the City adopt these changes, the property owner has agreed that the City may, but is not obligated to, process and adopt a future Comprehensive Plan Future Land Use Map amendment and rezoning to designate these properties subject to this Ordinance with the "Commercial' future land use designation and "General Commercial' zoning designation, provided that such designations allow community centers and religious institutions as allowable uses. SECTION II. Codification: It is the intention of the City Commission of the City of Longwood, Florida and it is hereby ordained that the provisions of the Ordinance shall become and be made a part of the City of Longwood, Florida adopted land use and zoning map. SECTION III Conflicts: If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. SECTION Ill. Severability: If any section or portion of a section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or part of this Ordinance. SECTION IV. Effective Date: This Ordinance shall become effective 31 days after adoption if no challenge is filed. FIRST READING this Ph day of FEBRUARY 2022.
