Giffin Chumley, City Attorney Also Present: Brittany Kidd Gelm, Code Compliance Officer 1. CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 9:00 a.m. 2. APPROVAL OF THE MINUTES FROM THE October 28, 2021 HEARING: Special Magistrate Goodblatt approved Minutes from the October 28, 2021 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. 4. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. 5. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. 6. PUBLIC HEARINGS: A. CEH 21-10-1709 LDC, Art. X Sec. 10.1.0 Construction Permit Wolk, Gina—Property Owner New Industry Studios-Tenant 937 Longdale Ave Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery document to the Special Magistrate. Respondent Property Owner, Gina Walk, was present. Respondent Tenant, Casieve Thompson and his contractor, Ed Linares, were also present. CEO Gelm stated that this property is in violation of LDC, Art. X Sec. 10.1.0 Construction Permit because interior alterations were completed without permits. CEH 11-17-2021 Page 1 of 4 CODE ENFORCEMENT HEARING City Commission Chambers 175 West Warren Avenue Longwood, FL 32750 A Notice of Violation was issued on 6/14/2021 and mailed via certified mail to the property owner and tenant.The NOV was delivered to the property owner and tenant on 6/21/2021. A Notice of Hearing was issued on 10/13/2021 and mailed via certified mail to the property owner and tenant.The NOH was delivered to the property owner and tenant on 10/18/2021. Phil Kersey, the City of Longwood Building Official, provided testimony that the Respondents were given 90 days to come into compliance but did not. The Respondent Property Owner provided testimony that she does not have plans for the building. The Respondent Tenant provided testimony that all of the work that was done was previously permitted but he does not have proof of such as the City does not have records of permits being issued or applied for. The Respondent Tenant's Contractor, Ed, provided testimony that he has been hired to rectify the violation and the architect he uses needs 2.5 months to complete the work. Special Magistrate made inquiry of the Code Compliance Officer and Respondents. The Special Magistrate made her findings,that interior alterations were made to the cited property without construction permits. The Respondents have violated LDC, Article X Section 10.1.0 Construction Permit. In order to come into compliance, Respondents must hire a licensed contractor to submit signed and sealed plans for the interior alterations. Once the permit is issued, all inspections must be called in and passed successfully. Respondents are to jointly and severally pay Administrative Costs of $150.00 within 30 days of receipt of Final Orders. If Respondents do not comply by March 1, 2022, by providing signed and sealed plans to the City and by calling for and passing all required inspections 30 days thereafter, Respondents shall pay a fine of$100.00 per day for each day the violation continues to exist beyond the date set for compliance. B. CEH 21-11-1711 LDC, Art. X Sec. 10.1.0 Construction Permit Dounia Dev. Inc. 956 & 958 W SR 434 Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery document to the Special Magistrate. The Respondent Property Owner was not present. CEO Gelm stated that this property is in violation of LDC, Art. X Sec. 10.1.0 Construction Permit because interior alterations and demolition were completed without permits. A Notice of Violation was issued on 10/19/2021 and mailed via certified mail to the property owner. The NOV was delivered to the property owner on 10/21/2021. A Notice of Hearing was issued on 10/26/2021 and mailed via certified mail to the property owner. The NOH was delivered to the property manager, Chantelle on 11/3/2021. Phil Kersey, the City of Longwood Building Official, provided testimony that he observed the entire interior of the unit was demolished. Special Magistrate made inquiry of the Code Compliance Officer. The Special Magistrate made her findings, that interior alterations and demolition were made to the cited property without construction permits.Service was properly made.The Respondents have violated LDC, Article X Section 10.1.0 Construction Permit. In order to come into compliance, Respondents must obtain permits for interior alterations and demolition. All required inspections must be completed successfully. Respondent is to pay Administrative Costs of $287.50 within 30 days of receipt of Final Orders. If Respondent does not comply within 10 days of receipt of Final Orders by securing demolition and interior alteration permits and by completing and passing all inspections required by permits 60 days thereafter, Respondents shall pay a fine of$100.00 per day for each day the violation continues to exist beyond the date set for compliance. 7. Special Magistrate signed the Order to Impose for CEH 21-08-1680 in reference to 490 E SR 434. C. Special Magistrate signed the Order to Impose for CEH 20-12-1615 in reference to 327 S Ronald Reagan Blvd. D. Special Magistrate signed the Order to Impose for CEH 21-07-1674 in reference to 136 Glendale Drive.
