21-2214 Amending Future Land Use Designation at 1580 and 1590 US Hwy 1792 ORDINANCE NO.21-2214 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD; SAID SMALL SCALE PLAN AND TEXT AMENDMENT (SPA 01-21) CHANGING THE FUTURE LAND USE MAP OF THE CITY OF LONGWOOD COMPREHENSIVE PLAN TO APPLY THE INFILL AND MIXED USE FUTURE LAND USE CATEGORY TO +/- 4.89 ACRES OF LAND LOCATED AT 1580 AND 1590 U.S.HWY. 17-92,LONGWOOD, FLORIDA AND WITH PARCEL ID'S 05-21-30-523-0000-00B0 AND 05-21-30-523-0000-00A8; ; AND CHANGING THE ZONING FROM COUNTY C-2(RETAIL COMMERCIAL)AND A-1(AGRICULTURAL)TO CITY EAST END PLANNING DISTRICT; AND AMENDING THE FUTURE LAND USE ELEMENT OF THE CITY OF LONGWOOD COMPREHENSIVE PLAN CREATING FUTURE LAND USE CATEGORIES, OBJECTIVE IV, POLICY B; PROVIDING FOR CODIFICATION, SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE. WHEREAS,Chapter 163, Part II, Florida Statutes, establishes the Community Planning Act ("Act"); and WHEREAS, the Act authorizes a local government to exercise comprehensive planning authority over territory within its jurisdiction; and WHEREAS, pursuant to the Act, the City of Longwood ("City") has adopted a comprehensive plan ("City's Comprehensive Plan"); and WHEREAS, the Act authorizes a local government desiring to revise its comprehensive plan to prepare and adopt comprehensive plan amendments; and WHEREAS, pursuant to Ordinance No. 21-2212 adopted on November 15, 2021,the City duly annexed the property described in Exhibit"A" attached hereto ("Property"), and, thus, the City is the local government having jurisdiction over the Property; and WHEREAS,the City has prepared an amendment to the Future Land Use Element and the Future Land Use Map of the City's Comprehensive Plan to encompass the Property and to designate the Property with an equivalent City future land use classification; and WHEREAS, after due public notice, the City's Local Planning Agency and the City Commission held the requisite public hearings pursuant to Sections 163.3174 and 163.3187, Florida Statutes, to afford an opportunity for public comments concerning the proposed amendment to the Future Land Use Element and the Future Land Use Map as set forth herein; Ordinance No.21-2214 SPA 04-21 Page 1of8 and WHEREAS,the City finds that the proposed amendment to the Future Land Use Element and the Future Land Use Map contained herein furthers the purposes of,and is consistent with, the City's Comprehensive Plan, and is consistent with and compliant with State law, including, but not limited to, Chapter 163, Part II, Florida Statutes, and Chapter 187, Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA,AS FOLLOWS: SECTION 1. FLU MAP AMENDMENT. The Future Land Use Map of the City's Comprehensive Plan is hereby amended to include the map amendment set forth in Exhibit "B," which applies the "Infill and Mixed Use"future land use category to the Property, as depicted in Exhibit"C"attached hereto and incorporated herein by reference. SECTION 2. FLU TEXT AMENDMENT. The Future Land Use Element of the City's Comprehensive Plan is hereby amended to include the text amendment set forth in Exhibit"B," which is attached hereto and incorporated herein by reference, and which creates Objective IV, Policy B to impose development limitations on the Property. SECTION 3. ZONING MAP AMENDMENT. The Zoning Map of the City of Longwood is hereby amended to assign the East End Planning District to the subject property, subject to the limitations specified in the Future Land Use Text Amendment. SECTION 4. SEVERABILITY. If any Section or portion of a Section of this Ordinance is declared by any court of competent jurisdiction to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance or the City's Comprehensive Plan. SECTION 5. CONFLICTS. In the event of a conflict between this Ordinance and any other ordinance of the City of Longwood or part thereof, this Ordinance shall control to the extent of the conflict. SECTION 6. FILING. Upon final passage and adoption of this Ordinance, the City shall forward a copy hereof to the Florida Department of Economic Opportunity and any other unit of local government or governmental agency in the State that has filed a written request with the City for a copy of the Comprehensive Plan amendment. SECTION 7. CODIFICATION. This Ordinance shall be incorporated into the City's Comprehensive Plan. Any section,paragraph number,letter and/or any heading may be changed or modified as necessary to effectuate the foregoing intent. Grammatical, typographical, and similar or like errors may be corrected, and additions, alterations, and omissions not affecting the construction or meaning of this Ordinance and the Comprehensive Plan may be freely made. SECTION 8. EFFECTIVE DATE. The effective date of this Ordinance shall be 31 days after its adoption unless the Comprehensive Plan amendment set forth herein is timely challenged in Ordinance No.21-2214 SPA 04-21 Page 2 of 8 accordance with general law. II. TEXT AMENDMENT A text amendment to the Future Land Use Element of the Comprehensive Plan creating Future Land Use Categories, Objective IV, Policy B is adopted as follows: Policy B. Future Land Use Map(FLUM)Amendment SPA 01-14 adopted by Ordinance 21-2214 on , 2022, changes the future land use on the amendment area from Seminole County MXD(Mixed)and LDR(Low Density Residential)to City of Longwood Infill and Mixed Use(IMU)for the +/- 4.89 acres property described in such ordinance ("subject property"). Development of the subject property shall meet the requirements of all applicable Goals, Objectives, and Policies of the Comprehensive Plan. Moreover, the land use and development potential for the subject property is hereby limited as provided below: A. Residential density on the subject property is limited to no more than fifty(50) dwelling units; and B. The maximum building height for residential uses and structures on the subject property is forty-five(45)feet and three (3)stories. C. No boat ramp for motorized watercraft to access Fairy Lake, whether new or existing, will be permitted as part of the final site development plan of any project that includes multi-family apartments on the subject property.
