CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 9:00 a.m. 2. APPROVAL OF THE MINUTES FROM THE June 23, 2022 HEARING: Special Magistrate Goodblatt approved Minutes from the June 23, 2022 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. 4. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. 5. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. 6. PUBLIC HEARINGS: A. CEH 22-07-1783 CC, Chapter 86 Section 86-83 Boat,Trailer& RV Parking Webb, Irma 458 Reider Avenue Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery document and photos to the Special Magistrate. Respondent was not present. CEO Gelm stated that this property is in violation of CC, Chapter 86 Section 86-83 Boat, Trailer& RV Parking because there was an RV improperly stored in the driveway past the date set for compliance.This was the 9th case for this same violation at this property. CEH 7-28-2022 Page 1 of 4 CODE ENFORCEMENT HEARING City Commission Chambers 175 West Warren Avenue Longwood, FL 32750 A Notice of Violation was issued on 5/16/22 and mailed via certified mail to the property owner.The NOV was mailed via First Class Mail to the property owner on 5/24/22 due to USPS tracking noting the certified NOV was "processed through USPS Facility 5/18/22." A Notice of Hearing was issued on 6/13/22 and mailed via certified mail to the property owner.The NOH was delivered to the property owner 6/28/22. Special Magistrate made inquiry of the Code Compliance Officer. The Special Magistrate made her findings, that an RV has been stored in the front of the cited residential property since 5/5/22. Prior to this NOV, the property owner has been cited 8 times for the same violation. Service was properly made. The Respondent has violated 86 Section 86-83 Boat,Trailer& RV Parking.An RV may not be parked in the front of the property, it must be stored in the side or rear yard behind the front line of the house or actual side corner lot building line. Respondent is to pay Administrative Costs of $263.23 within 30 days of receipt of Final Orders. B. CEH 22-07-1787 CC,Chapter 74 Section 74-32 Stormwater/Illicit Discharge Millenium Inv. Holdings Corp. IV 1490 S US HWY 1792 Longwood, FL 32750 CEO Gelm introduced herself and presented a Cost Recovery document, photos and Longwood Public Works Supervisor Matt Hockenberry's Storm Water Reports to the Special Magistrate. Respondent was not present. CEO Gelm stated that this property is in violation of CC, Chapter 74 Section 74-32 Stormwater/Illicit Discharge because construction activities took place without proper erosion control devices being installed. A Notice of Violation was issued on 6/1/22 and mailed via certified mail to the property owner.The NOV was delivered on 6/6/22. A Notice of Hearing was issued on 6/17/22 and mailed via certified mail to the property owner.The NOH was delivered on 6/21/22. Special Magistrate made inquiry of the Code Compliance Officer. The Special Magistrate made her findings, that the Respondent has violated CC, Chapter 74 Section 74-32 Stormwater/Illicit Discharge in that construction activities were undertaken at the cited property, without the necessary precautions to prevent erosion control. As a result, storm water discharge impaired the City's erosion, sediment and pollution controls. The violations were failure to install a secured silt fence, incorrectly CEH 7-28-2022 Page 2 of 4 CODE ENFORCEMENT HEARING City Commission Chambers 175 West Warren Avenue Longwood, FL 32750 installing the original silt fence, causing washout to leak into the lake without cleaning it up and failing to install a turbidity barrier in the lake. Service was properly made. All of the violations were later corrected except for the turbidity barrier and the double layered silt fence. In order to come into compliance, Respondent must repair the double layer silt fence and install a turbidity barrier in the lake. A permit is not required for installation. If Respondent does not comply within 15 days from the date of service of this Order, the Respondent shall pay a fine of$150.00 per day for each day the violation continues to exist beyond the date set for compliance. Respondent must also pay an Administrative Fine of$295.27 within 30 days of receipt of Final Orders. C. CEH 22-07-1789 CC, Chapter 86 Section 86-83 Boat,Trailer& RV Parking Winne, Carolyn 1082 Hamilton Avenue Longwood, FL 32750 This case was withdrawn as complied on 7/25/2022. 7. REPORTS-CASE UPDATES None. 8. UNFINISHED BUSINESS None. 9. OLD BUSINESS A. Special Magistrate signed the Order to Impose for CEH 22-04-1747 in reference to 417 Tullis Avenue. Respondent was not present. B. Special Magistrate signed the Order to Impose for CEH 22-05-1752 in reference to 225 E Warren Avenue. Respondent was not present. C. Special Magistrate reduced the Fine for CEH 22-03-1732 in reference to 1066 Foggy Brook Place to $$1,281.22 if paid by 8/3/2022. Respondent Dennis Rizza was present and advised he was not contesting the Fines but was asking for a reduction. 10. NEW BUSINESS Special Magistrate requested an Affidavit of Service for the Order to Impose Notices that are not confirmed delivered via certified mail.
