RESOLUTION NO. 23-1633
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
LONGWOOD, FLORIDA, ESTABLISHING A CHARTER ADVISORY
COMMITTEE; PROVIDING FOR QUALIFICATONS FOR
MEMBERSHIP OF THE COMMITTEE; ESTABLISHING
RESPONSIBILITIES AND REPORTING REQUIREMENTS; PROVIDING
FOR LEGAL AND STAFF ASSISTANCE TO THE COMMITTEE;
PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS,Section 10.01(c)of the City Charter provides for the periodic review of the City
of Longwood Charter, the City Commission hereby creates a temporary five-member Charter
Advisory Committee for the purpose of evaluating the City Charter for potential amendments
and making recommendations concerning the same to the City Commission; and
WHEREAS,the last Charter review was conducted in 2019-2020, and the City Commission
desires to provide an open, objective, and deliberative process to provide ample opportunity for
the public to participate in the City Charter amendment process; and
WHEREAS,the Longwood City Commission finds that this Resolution is in the best interest
and welfare of the residents of the City of Longwood.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
LONGWOOD, FLORIDA,AS FOLLOWS:
Section 1. Recitals. The above recitals are true and correct and are incorporated
herein by this reference.
Section 2. Creation. The City Commission hereby creates the Charter Review
Advisory Committee ("Committee") for the purpose of evaluating the City Charter for potential
amendments and making recommendations concerning the same to the City Commission. The
Committee is an ad hoc committee that is intended to sunset as set forth herein. The Committee
shall consist of five (5) members to be appointed by the City Commission. Each Commissioner
shall nominate for appointment one (1) member to the Committee for approval by the City
Commission. There shall be a member on the Committee representing each of the five (5)
Commission Districts. The members shall serve for the duration of the Committee as provided
herein. Any vacancy created by the incapacity, resignation, or otherwise of a member shall be
filled at the next regular meeting of the City Commission upon selection by the original appointing
Commission Member.

Section 3. Qualifications. Members of the Committee shall be residents and qualified
voters of the City and shall remain City residents for the duration of their membership on the
Committee. The Mayor and Commissioners shall confirm that their appointments are willing to
serve, are available to attend all required meetings, and carry out the responsibilities of the
Charter Review Advisory Committee as provided by in this Resolution. The Appointees shall
submit to the City Clerk prior to appointment a completed Board Application Form. Members of
the Committee shall also abide by the City Code Chapter 2—Article VI Codes of Conduct for Board
Members.
Section 4. Committee Responsibilities. The Committee shall have the responsibility
of reviewing the existing City Charter and providing written recommendations to the City
Commission. A majority vote of the Committee must approve the recommendations of the
Committee to the City Commission. The Committee shall elect from its membership a Chair and
Vice-Chair.
Section 5. Reporting Requirements. The Committee shall present its final report and
recommendations to the City Commission no later than the City Commission's meeting on March
4, 2024. The City Commission, upon receipt of the findings and recommendations of the
Committee, shall review the same and determine whether the existing Charter should be
amended or revised. The City Commission may cause to be prepared such Ordinance or
Ordinances as it may deem advisable to amend or revise the existing City Charter in the manner
as provided by Chapter 166, Florida Statutes.
Section 6. Legal and Staff Assistance. The Committee shall be provided legal
assistance by the City Attorney and staff assistance by the City Clerk's Office. The City Attorney
and City Clerk shall facilitate the Charter review process. The City Attorney, City Clerk, and City
Manager shall provide reasonable assistance to the Committee as needed.
Section 7. Committee Meetings. All meetings of the Committee shall be noticed and
open to the public and generally conducted in accordance with the provisions of Section 2-313,
City of Longwood Code of Ordinances. The City Manager, City Clerk and City Attorney shall
provide reasonable assistance to the Committee as needed.
Section 8. Sunset. The Charter Review Advisory Committee shall sunset and
terminate on March 31,2024, unless terminated earlier or extended by majority vote of the City
Commission.
Section 9. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the
provisions of this Resolution are hereby repealed.

Section 10. Severability. If any Section or portion of a Section of this Resolution proves
to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity,
force, or effect of any other Section or part of this Resolution.
Section 11. Effective Date. This Resolution shall take effect immediately upon
adoption.
