CEH-01-25-2024-MINS CODE ENFORCEMENT HEARING Longwood City Commission Chambers 175 West Warren Avenue Longwood, Florida MINUTES January 25, 2024 9:00 A.M. Present: Amy Goodblatt, Special Magistrate J. Giffin Chumley, City Attorney Also Present: Phil Kersey, CBO, Building Official 1. CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 9:00 a.m. 2. APPROVAL OF THE MINUTES FROM THE DECEMBER 15, 2023 HEARING: Special Magistrate Goodblatt approved Minutes from the December 15, 2023 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. 4. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. 5. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. 6. PUBLIC HEARINGS: A. CE23-00203 CC, CHAPTER 90 SECTION 90-31 Water/Sewer Connection Required CEH 1-25-2024/1 SCOTT, RODNEY 1414 Meadowlark St. Longwood FL 32750 Phil Kersey, CBO, City of Longwood Building Official and Code Enforcement Supervisor, introduced himself and presented a cost recovery document to the Special Magistrate. The Respondent was not present. Mr. Kersey stated that the property was in violation of CC, Chapter 90 Section 90- 31, Water/Sewer Connections. The property was not connected to the City Utilities as required. Compliance was not met after the date set by the City to re- connect to its utilities. A Notice of Violation was issued on 9/6/23 and mailed to the property owner via certified mailing. The Notice of Violation was received by and marked return to sender. The Notice of Violation was posted on the property, at City of Longwood City Hall and mailed first class to the property owner on 10/5/23. A Notice of Hearing was issued on 1/3/24 and mailed to the property owner via certified mail. Confirmation was received of the Notice of Hearing being delivered on 1/5/24. Special Magistrate made inquiries of Mr. Kersey. The Special Magistrate found that the Property Owner failed to connect with City Public Utilities after notice was given. The Respondent has violated Water/Sewer Connections CC, Chapter 90 Section 90-31. Service was properly made. The Respondent was to re-connect to all city utilities, in a legal manner including but not limited to water and sewer systems. The Respondent was to pay administrative costs of$313.98 within 30 days of service of the Final Orders. If the Respondent does not comply within 15 days from the date of service of the Final Orders, the Respondent shall pay a fine of$50.00 per day for each day the violation continues to exist beyond the date set for compliance. B. CE23-00243 CC, CHAPTER 18 SECTION 18-2 Hours of Operation 140 NORTH LLC RDP 19 LLC 189 S Ronald Reagan Blvd. Longwood FL 32750 CEH 1-25-2024/2 Phil Kersey, CBO, City of Longwood Building Official and Code Enforcement Supervisor, introduced himself and presented a cost recovery document and date and time stamped photos to the Special Magistrate. The Respondent was not present. Mr. Kersey stated that the property was in violation of CC, Chapter 18, Section 18- 2 Hours of Operation. Mr. Kersey gave the following testimony:Construction work took place after City approved hours (after 6:00 pm) at the cited property on multiple occasions. Six (6) complaints were made to the City by email. After Notice was given, the work continued. This issue has been ongoing. Acceptable work hours were discussed with Respondent's representative at all pre- construction meetings. Respondent was reminded of legal work hours on several occasions. Two (2)Stop Work Orders and Two (2)$100 fines were issued and paid. A Notice of Violation was issued on 10/13/23 and a second Notice of Violation was issued on 10/27/23 and mailed to the property owner via certified mailing. Confirmation was received of the Notice of Violation being delivered on 10/17/23 for the first and 10/27/23 for the second. A Notice of Hearing was issued on 1/3/24 and mailed to the property owner via certified mail. Confirmation was received of the Notice of Hearing being delivered on 1/5/24. Special Magistrate made inquiries of Mr. Kersey. The Special Magistrate found that the Respondent has violated CC, Chapter 18, Section 18-2 Hours of Operation. Service was properly made. The Respondent was to adhere to the City code in that all construction work may only be done between the hours of 7:00 am until 6:00 pm, Monday through Friday and between 8:00 am until 5:00 pm on Saturdays. No such work may be undertaken on Sundays or City holidays. The Respondent was to pay administrative costs of$471.98 within 30 days of service of the Final Orders. If another violation occurs it will be considered a repeat violation and a fine of$500 per each incident will automatically be applied. C.
