CEH-04-25-2024-MINS CODE ENFORCEMENT HEARING Longwood City Commission Chambers 175 West Warren Avenue Longwood, Florida MINUTES April 25, 2024 9:00 A.M. Present: Amy Goodblatt, Special Magistrate Brandon Pownall, City Attorney Also Present: Shelly Brana, Code Enforcement Officer Phil Kersey, CBO, Building Official Sudha M. Dahya, Respondent Anas Zaben, Respondent 1. CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 9:00 a.m. 2. APPROVAL OF THE MINUTES FROM THE MARCH 28, 2024 HEARING: Special Magistrate Goodblatt approved Minutes from the March 28, 2024 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. 4. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. 5. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. 6. PUBLIC HEARINGS: A. CE2-00018 LDC, ARTICLE X SECTION 10.1.0 1}, CEH 4-25-2024/1 No Permit MUKESH & SUDHA INV LLC 274 W SR 434 Longwood FL 32750 Code Enforcement Officer Brana introduced herself and presented a cost recovery document and photographs to the Special Magistrate and Respondent(s). The Respondent(s) were present. Code Enforcement Officer Brana stated that the property was in violation of LDC, ARTICLE X SECTION 10.1.0 No Permit. She testified that development activity in the form of additions to and alterations of the ommercial cooking systems was J undertaken without a permit and a stop Wo Order was issued and placed on site. The respondents were advised multiple times what needed to be done to come into compliance The Building Official, Mr. Kersey, testified he saw the alterations both inside and outside the property A Notice of Violation was issued on 2/7/24 and mailed to the property owner via certified mailing. The Notice of Violation was hand delivered to the tenant, Anas Zaben, on 2/8/24 with an affidavit of service being notarized. The Notice of Violation was received by the property owner on 2/12/24. A Notice of Hearing was issued on 3/8//24 and mailed to the property owner via certified mail. Confirmation was received of the Notice of Hearing being delivered on 3/12/24. The Respondent tenant, Anas Zaben, gave the following testimony: This is all his responsibility. The Stop Work Order was issued without an inspection. He does not know how the Stop Work Order was issued. He spoke with Mr. Kersey and the Florida Department of Business and Professional Regulation (DBPR) to change the use to a restaurant from a bakery. It will cost $27,000 to correct the hoods with a contractor. He spent $1,310 to have the hood tested. Nothing is connected. On Friday, April 26, 2024, the hood will be inspected. Respondent wants to open his restaurant. Sudha Pahya, on behalf of the Owner, requested they be given until Jun 152024 to come into compliance. ii The Special Magistrate made inquiries of the Code Enforcement Officer and the Respondent(s). The Special Magistrate found that development activity took place at the cited property, in the form of alterations to the commercial cooking systems without the necessary permits after a Stop Work Order was issued and a Notice of Violation was issued on the Respondent. The Respondent(s) have violated LDC, CEH 4-25-2024/2 ARTICLE X SECTION 10.1.0 No Permit. If the Respondent does not comply by June 15, 2024, by securing all necessary permits and by completing and passing all inspection requirements of the City within the time requirements of the Building Code, the Respondent shall pay a fine of $50 per day for each day the violation continues to exist beyond the date set for compliance. The Respondent(s) are to jointly and severally pay an administrative cost of $298.16 within 30 days of service of the Final orders. B.
