CEH-05-23-2024-MINS CODE ENFORCEMENT HEARING Longwood City Commission Chambers 175 West Warren Avenue Longwood, Florida MINUTES May 23, 2024 9:00 A.M. Present: Amy Goodblatt, Special Magistrate Brandon Pownall, City Attorney Also Present: Shelly Brana, Code Enforcement Officer Nathan and Brian Roy, Niemeyer House LLC, Respondent Rodney Scott, Respondent Joseph Nemchik, Respondent 1. CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 9:00 a.m. 2. APPROVAL OF THE MINUTES FROM THE APRIL 25, 2024 HEARING: Special Magistrate Goodblatt approved Minutes from the April 25, 2024 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. 4. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt did a roll call of the scheduled cases to determine which Respondents were present. 5. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. 6. PUBLIC HEARINGS: CEH 5-23-2024/1 A. CE23-00211 LDC, ARTICLE X SECTION 10.1.0 No Permit NIEMEYER HOUSE LLC 192 W Warren Ave. Longwood FL 32750 Shelly Brana, CEO, City of Longwood Code Enforcement Officer, introduced herself and presented a cost recovery document and photographs to the Special Magistrate and Respondent(s). The Respondent(s) were present. Ms. Brana stated that the property was in violation of LDC, ARTICLE X SECTION 10.1.0 No Permit. She testified that development activity in the form of porch repairs, replacement and structural work was undertaken without a permit and a Stop Work Order was issued and placed on site on 9/6/23. A Notice of Violation was issued on 9/7/23 and 2/5/24 and mailed to the property owner via certified mailing. Confirmation was received of the Notice of Violation being delivered on 9/11/23 and 2/8/24. A Notice of Hearing was issued on 4/3/24 and mailed to the property owner via certified mail. Confirmation was received of the Notice of Hearing being delivered on 4/8/24. The Respondent property owner, Brian Roy,testified he is the Father of the owner. He owns 3 other properties in Longwood. He has a history of restoring homes. He started work to assess what the architect needed. Work was stopped after the Stop Work Order was issued. There are financial issues with the costs and the architect that have stalled the work. He believed because work stopped he was not in violation. He has a set of plans but it will be 45 days for him to determine which options for renovations will be selected. The Special Magistrate made inquiries of the Code Enforcement Officer and the Respondent(s). The Special Magistrate found that development activity took place at the cited property, in the form of structural repairs, replacement and other construction alterations were made to the cited property without securing the necessary permit. The Respondent(s) have violated LDC, ARTICLE X SECTION 10.1.0 No Permit. The Respondent is to pay an administrative cost of$175 within 30 days of service of the Final Orders. If the Respondent does not comply by obtaining permits from the City for all alterations made to the property by August 1, 2024 the Respondent shall pay a fine of$50 per day for each day the violation continues to exist beyond the date set for compliance. CE23-00261 LDC, ARTICLE X SECTION 10.1.0 No Permit 2018-2 1H BORROWER LP 500 Devonshire Blvd. Longwood FL 32750 Shelly Brana, CEO, City of Longwood Code Enforcement Officer, introduced herself and presented a cost recovery document and photographs to the Special Magistrate and Respondent(s). The Respondent(s) were not present. Ms. Brana stated that the property was in violation of LDC, ARTICLE X SECTION 10.1.0 No Permit. She testified that a fence was installed at the cited property without first obtaining the required permit. The City emailed the property manager about the violation on more than one occasion. The City Building Official was consulted due to the uniqueness of the fence's placement. A Notice of Violation was issued on 11/7/23 and mailed to the property owner via certified mailing. Confirmation was received of the Notice of Violation being delivered on 11/10/23. A Notice of Hearing was issued on 4/3/24 and mailed to the property owner via certified mail. Confirmation was received of the Notice of Hearing being delivered on 4/8/24. The Special Magistrate made inquiries of the Code Enforcement Officer. The Special Magistrate found that development activity took place at the cited property by erecting a fence without securing the necessary permit. The Respondent(s) have violated LDC, ARTICLE X SECTION 10.1.0 No Permit. The Respondent is to pay an administrative cost of$328.58 within 30 days of service of the Final Orders. If the Respondent does not comply within 15 days from the date of service of the Final Orders by obtaining permits from the City, the Respondent shall pay a fine of$20 per day for each day the violation continues to exist beyond the date set for compliance. 7. REPORTS-CASE UPDATES None. 8. UNFINISHED BUSINESS CEH 5-23-2024/3 A. Special Magistrate to sign the Order to Impose for CE23-00203; CE23-00204; CE23-00205 in reference to 1414 Meadowlark St. The Special Magistrate heard testimony from, Shelly Brana, CEO, and the property owner Rodney Scott and Joseph Nemchik. The Special Magistrate will make her determination of the amount of the liens at the June 27, 2024 Special Magistrate hearing. 9. OLD BUSINESS None. 10. NEW BUSINESS None. 11.
