AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019,
SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA;
SAID SMALL SCALE PLAN AMENDMENT (SPA 01-25, P25-00263) CHANGING THE LAND USE
DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM CITY OF
LONGWOOD MEDIUM DENSITY RESIDENTIAL (MDR) TO CITY OF LONGWOOD COMMERCIAL
(COM) AND THE ZONING DESIGNATION FROM CITY OF LONGWOOD MEDIUM DENSITY
RESIDENTIAL-15 (MDR-15) TO CITY OF LONGWOOD NEIGHBORHOOD COMMERCIAL (NC) FOR
THE PROPERTY WITH PARCEL ID 33-20-30-517-0A02-0000; PROVIDING FOR CONFLICTS,
SEVERABILITY AND EFFECTIVE DATE
WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan
(Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and
Chapter 9J-5 Florida Administrative Code; and
WHEREAS, Rafael A. Gonzalez, authorized by the property owner, Kimberly English, has
requested a small-scale land use amendment to amend the City's future land use map for Parcel
ID 33-20-30-517-0A02-0000 located within the City of Longwood, described in Section I; and
WHEREAS, the property owner, Kimberly English, is unable to acquire a commercial loan
for refinancing the property because the current use is a daycare center which is not allowed in
the Medium Density Residential (MDR) land use and the Medium Density Residential-15 (MDR-
15) zoning district; and
WHEREAS, the applicant, Rafael A. Gonzalez, representing the property owner, Kimberly
English, would like to change the land use from Medium Density Residential (MDR) to
Commercial (COM) and zoning from Medium Density Residential-15 (MDR-15) to Neighborhood
Commercial (NC) which would allow the daycare center use and allow them to qualify for
commercial lending; and

WHEREAS, the proposed future land use of Commercial (COM) and zoning designation of
Neighborhood Commercial (NC) for the property is consistent with City of Longwood
Comprehensive Plan and its goals, policies and objectives; and
WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency
(LPA) to make recommendations to the governing body regarding amendments to the
Comprehensive Plan; and
WHEREAS, the LPA held a public hearing on May 14, 2025 to consider the Small-Scale
Plan Amendment request; and recommended the proposed Small-Scale Plan Amendment (SPA
01-25; P25-00263) be approved by the City Commission; and
WHEREAS, the City Commission held an initial reading on May 19, 2025 and a public
hearing on June 2, 2025 pursuant to the requirements of Chapter 163.3187, FS.
WHEREAS, the City Commission of the City of Longwood, Florida has held a public
hearing with due public notice to consider the future land use and zoning map amendments of
the property hereinafter described and at such hearing, interested parties and citizens for
and/or against the proposed establishment of the City of Longwood future land use and zoning
designation were heard; and
WHEREAS, the Small-Scale Plan Amendment adopted by this Ordinance is internally
consistent with the City of Longwood Comprehensive Plan and its goals, policies and objectives.
BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD,
FLORIDA, AS FOLLOWS:

SECTION I: The following portions of the Future Land Use Map and Zoning Map of
the Comprehensive Plan are hereby amended to change the land use designation of the
properties described as:
Property ID: 33-20-30-517-0A02-0000
as depicted in EXHIBIT A, CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE
MAP OF THE COMPREHENSIVE PLAN FROM CITY OF LONGWOOD MEDIUM DENSITY
RESIDENTIAL (MDR) TO CITY OF LONGWOOD COMMERCIAL (COM) AND ON THE ZONING MAP
FROM LONGWOOD MEDIUM DENSITY RESIDENTIAL-15 (MDR-15) TO NEIGHBORHOOD
COMMERCIAL(NC) attached hereto as though fully contained herein.
SECTION II. Codification: It is the intention of the City Commission of the City of
Longwood, Florida and it is hereby ordained that the provisions of the Ordinance shall
become and be made a part of the City of Longwood, Florida adopted land use and
zoning map.
SECTION III Conflicts: If any Ordinance or part thereof is in conflict herewith, this
Ordinance shall control to the extent of the conflict.
SECTION IV. Severability: If any section or portion of a section of this Ordinance
proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or
impair the validity, force, or effect of any other section or part of this Ordinance.
SECTION V. Effective Date: This Ordinance shall become effective 31 days after
adoption if no challenge is filed.
