25-2274 Granting an Exclusive Franchise to Wast Pro of Florida, Inc. ORDINANCE 25-2274 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, GRANTING AN EXCLUSIVE FRANCHISE TO WASTE PRO OF FLORIDA, INC. FOR RESIDENTIAL SOLID WASTE AND RECYCLING COLLECTION SERVICES AND APPROVING A CONTRACT WITH WASTE PRO OF FLORIDA, INC. FOR A SEVEN- YEAR TERM COMMENCING ON OCTOBER 1, 2025, PROVIDING FOR A FOUR-YEAR RENEWAL TERM FOR SUCH CONTRACT UPON MUTUAL AGREEMENT OF THE PARTIES AND APPROVING CUSTOMER RATES AS SET FORTH IN THE CONTRACT; PROVIDING FOR CONFLICTS, SEVERABILITY,AND AN EFFECTIVE DATE. WHEREAS,the City of Longwood("City)has previously granted an exclusive franchise to Waste Pro of Florida, Inc. for residential solid waste and recycling collection services within the City,the term of which expires on September 30, 2025; and WHEREAS, the City of Longwood ("City), pursuant to the authority granted by Article VIII, Section 2, Florida Constitution, Section 166.021, Florida Statutes, Section 180.14, Florida Statutes, and Chapter 403, Part IV, Florida Statutes, may grant to private companies or corporations the privilege or franchise for the collection and disposal of solid waste, other waste, and recyclable material for such term of years and upon such conditions and limitations as may be deemed expedient and for the best interest of the City; and WHEREAS, Section 3.10, Longwood City Charter requires the adoption of an ordinance to grant a franchise; and WHEREAS, Section 62-36, Longwood City Code exempts solid waste and recycling contacts from the competitive procurement requirements; and WHEREAS, the City Commission has determined it to be in the best interest of the City and residential solid waste and recycling customers to grant an exclusive franchise to Waste Pro of Florida, Inc. commencing on October 1, 2025 for an initial seven-year term pursuant to the Solid Waste and Recycling Collection Services Contract attached to this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD,FLORIDA,AS FOLLOWS: SECTION 1. GRANTING OF FRANCHISE AND APPROVAL OF CONTRACT. The City of Longwood City Commission hereby grants to Waste Pro of Florida, Inc. an exclusive franchise for residential solid waste and recycling collection services pursuant to the terms and conditions of the Solid Waste and Recycling Collection Services Contract commencing on October 1, 2025 between the City of Longwood and Waste Pro of Florida, Inc. attached to this Ordinance ("Contract"). Further, the City Commission hereby approves the Contract and authorizes the Mayor and the City Clerk to execute the Contract on the City's behalf. Ordinance No.25-2274 Page 1 of 2 SECTION 2. CONFLICTS. In the event of a conflict or conflicts between this Ordinance and any other ordinance or provision of law, this Ordinance controls to the extent of the conflict, as allowable under the law. SECTION 3. SEVERABILITY. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural,or any other reason, such portion shall be deemed a separate,distinct and independent provision,and such holding shall not affect the validity of the remaining portions of this ordinance. SECTION 4. EFFECTIVE DATE.
