26-1724 Establishing a Revised Fee Schedule of Fees for Building Permits and Related Services RESOLUTION NO. 26-1724 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, ESTABLISHING A REVISED SCHEDULE OF FEES FOR BUILDING PERMITS AND RELATED SERVICES; PROVIDING FOR METHODOLOGY BASED ON THE INTERNATIONAL CODE COUNCIL BUILDING VALUATION DATA; PROVIDING FOR COMPLIANCE WITH FLORIDA STATUTORY COST-RECOVERY MANDATES AND TRANSPARENCY REQUIREMENTS; REPEALING RESOLUTION NO. 24-1671 AND ALL RESOLUTIONS IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 553.80, Florida Statutes, and Chapter 18 of the City of Longwood Code of Ordinances authorize the City Commission to establish a fee schedule by resolution to fund the enforcement of the Florida Building Code; and WHEREAS, Article II of Chapter 18 of the Code of Ordinances, City of Longwood, Florida provides for the establishment of building and related permit fees by resolution of the City Commission; and WHEREAS, Florida statutory mandates, including the transparency and cost-limitation provisions of House Bill 803, dictate that local regulatory fees must be reasonable, equitable, and strictly proportional to the actual operational costs of plan review, inspections, and administration; and WHEREAS, a comprehensive departmental cost study analyzed the authorized building division operating budget and separated non-variable administrative overhead from variable factors including plan review and inspections; and WHEREAS, this cost-recovery analysis resulted in a fee schedule based on a flat administrative overhead fee, fees based on the actual cost to the jurisdiction, and a justifiable master structural multiplier based on International Code Council (ICC) Building Valuation Data (BVD) volumes; WHEREAS, the City Commission previously adopted Resolution No. 24-1671 to establish a schedule of fees for building and related permit fees, and this Resolution is intended to replace said resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, SEMINOLE COUNTY, FLORIDA: Section 1: That the following schedule of fees be established for Building Permits and related services. Resolution No.26-1724 Page 1 of 8 ADOPTION AND COMPLIANCE NOTE Pursuant to Florida statutory transparency guidelines and local cost-recovery mandates, all fees listed below are derived strictly from actual department operating costs. The full, itemized time-study workbooks detailing hourly inspector/plan examiner labor rates, standard project hours, and fixed structural infrastructure allocations are maintained by the Building Official and are available for public review upon request. METHOD FOR DETERMINING VALUE OF BUILDINGS Construction Cost/Valuation for Master Structural Permits will be calculated using the most current published edition of the "Building Valuation Data" chart as published by the International Code Council. The Building Official shall utilize this independent baseline to establish the structural valuation of proposed work. Separate, individual permits and corresponding flat fees are not required for associated trade work (including Electrical, Plumbing, Mechanical, and Gas sub-permits) for master structural permits. GENERAL COMPLIANCE AND ADMINISTRATIVE FEES • Division Overhead Fee:$85.41.A flat fee applied per permit application to cover base intake and core administrative operations. • State Surcharges O 1.5%of the total permit fee subtotal with a $2.00 minimum (§468.631) O 1%of the total permit fees with a $2.00 minimum (§ 553.721) • Digital As-Builts. Digital copies of all as-builts shall be submitted prior to issuance of a certificate of occupancy for non-residential and multi-family projects. • Other Fees and Charges.The applicant is responsible for other related fees and charges not enumerated in this schedule prior to receiving building permits as required by law.These include, but are not limited to, City and Seminole County impact fees and any additional engineering or architectural service fees charged for additional services rendered, including those that fall under the City's cost recovery policy. • Permit Expiration and Renewal. If a permit is not renewed prior to the expiration date,the applicant will be required to resubmit plans and specifications for the appropriate category and pay the appropriate fees. In the event the code changes editions, then the re-submission of the expired application will be based on the most current adopted code edition. • Penalties: o For work commencing prior to the issuance of an approved permit(Longwood City Code Sec. 18-154). Any person commencing work without an approved permit shall be subject to an administrative penalty fee in the amount of double the calculated permit Resolution No.26-1724 Page 2 of 8 fee. As an example, if the permit fee is$100, a penalty in the amount of$200 will be assessed, making for a total of$300. o For permitted work that violates Section 115.1 of the Florida Building Code, Administrative Section, a fine of$100 will be assessed. • Refunds: For projects that are cancelled after fees are paid, a 75% refund of the permit fee shall apply. Projects that have begun construction shall not be eligible for any refund.The Department Overhead Fee is nonrefundable. • Undefined Permits. Where a permit type is not specified in this fee schedule, the Building Official may charge a fee derived from actual costs including the Division Overhead fee, plan review, processing, and required inspections based on defined hourly rates for personnel, surcharges, and any other appropriate fees detailed in this fee schedule and consistent with State law. Resolution No.26-1724 Page 6 of 8 • PLAN REVISIONS/SUPPLEMENTAL SUBMITTALS: $35.00-fiat processing fee plus an hourly labor charge of$46.76 per hour for digital plan review time exceeding 30 minutes. • CHANGE OF SUB-CONTRACTORS (ANY OR ALL): $25.00 processing charge. • REISSUE OF PERMIT TO NEW CONTRACTOR: $25.00 administrative charge. • DUPLICATE OF PERMIT DOCUMENTS(LOST,STOLEN, ETC.): $10.00 digital administrative file fee. • AFTER HOURS INSPECTIONS (SOLE DISCRETION OF BUILDING OFFICIAL): Written request required 96 hours prior to event. Limited to true emergencies and critical electrical shutdowns. Hourly Labor Rate: $100.00 per hour; Weekday Minimum Charge: 2 Hours($200.00 minimum); Weekend/ Holiday Minimum Charge: 4 Hours ($400.00 minimum). PRIVATE PROVIDER APPLICATION FEE REDUCTIONS In compliance with the local government mandates of Florida House Bill 803 and F.S. § 553.791, when a fee owner elects to utilize a qualified, licensed Private Provider to perform alternative code compliance plans review or inspection services,the corresponding fees shall receive a mandatory reduction from the standard schedule baseline: • Private Provider Plans Review Only: The structural master permit fee or flat specialty permit fee shall receive a mandatory reduction of 25%from the standard schedule baseline. • Private Provider Inspections Only:The structural master permit fee or flat specialty permit fee shall receive a mandatory reduction of 25%from the standard schedule baseline. • Full Private Provider Election (Plans Review and Inspections):The total building permit fee baseline shall be reduced by 50%. • Exemptions: Core administrative infrastructure costs (including the flat$85.41 Department Overhead Fee), external agency secondary impacts are non-reducible and remain subject to full cost-recovery tracking. Local enforcement agencies retain full statutory authority to charge standard administrative processing/registration tracking fees. Section 2. Recitals. The above recitals are true and correct and are incorporated herein by this reference. Section 3. Repeal. Resolution 24-1671 shall be repealed. Section 4. Effective Date.
